SIMILAC® CUSTOM NURSERY DESIGN CONTEST WITH TY PENNINGTON

  1. HERE'S HOW IT WORKS: Everyone knows the importance of a baby’s nursery when caring for a newborn. If your baby’s nursery is in desperate need of a design, Similac® and Ty Pennington invite you to submit an original statement describing why you are deserving of a nursery design along with a description of your dream nursery (statement must be 100 words or fewer). See Rule #3 for entry instructions and deadlines.

  2. ELIGIBILITY: This contest is open only to residents of the 50 United States or Washington, D.C., who are 18 years of age or older as of date of entry and who are parents/legal guardians of children who were born on or after January 1, 2008 or expectant parents/legal guardians whose child is due within ten months of date of entry. Employees of Sponsor, its affiliates, subsidiaries, advertising, promotion and internet agencies and their immediate family members and/or those living in the same household of each are not eligible. All federal, state and local laws and regulations apply. Void where prohibited by law.

  3. TO ENTER: Beginning September 8, 2008 at 12:01AM (Eastern Time), visit www.similacsimplepac.com and follow the on-screen entry instructions to complete the contest entry form and submit your original statement. Entries must be received by 11:59:59 PM ET on the last day of entry for the contest period you intend to enter, as indicated in the chart below. Limit one entry per email address throughout the promotion. If more than one entry is received per person, only the first such entry received will be eligible. Entry must be your original work that has not been previously published nor won a prize or award. All entries must be in English.

  4. JUDGING: All entries will be preliminarily judged by D.L. Blair, Inc., an independent judging organization whose decisions are final, to determine the top ten (10) entries in each of the four contest periods. The top ten (10) entries in each of the four contest periods will then be judged by a panel from Sponsor, who, at their sole discretion, will determine the winners in each contest period. All judging will be based on the following criteria: (40%) Relevance to Contest Theme, (20%) Inspirational Quality, (20%) Originality & Creativity, and (20%) Sincerity. In the event of a tie, the tied entries will be re-judged based on the criteria listed above.

  5. PRIZES & APPROXIMATE RETAIL VALUES: Four (4) First Prizes (1 awarded in each of the 4 entry periods) — A check for $10,000.00 for use towards a nursery design, a consultation with a local designer and a personalized congratulatory message and photograph from Ty Pennington along with tips for redesigning the winner’s nursery (ARV $14,000.00); Twelve (12) Second Prizes (3 awarded in each of the 4 entry periods) — A $1,000.00 check for use towards a nursery design along with an autographed photograph of Ty (ARV $1,000.00). There is no retail value associated with the congratulatory message and autograph portion of prizes. Prizes consist only of those items specifically listed as part of the prize.

  6. GENERAL RULES: Potential First and Second Prize winners must sign and return an affidavit of eligibility/release of liability/publicity release within four (4) days of attempted notification. On the affidavit, First and Second Prize winners will be required to certify that the entry submitted is their own original work and they hold all rights to the submission, that the submission has not been previously published, has not won a previous prize or award and that they have followed the Official Rules of the Contest. If potential First or Second Prize winner is deemed a minor in his/her state of residence, a parent or legal guardian will be required to execute required documents on behalf of the potential winner. Noncompliance within the time period stated above may result in disqualification and an alternate may be selected. Entries may not contain profanities or obscenities and may not in any way disparage persons or organizations associated with Sponsor. Sponsor reserves the right in its sole discretion to disqualify any entry it determines to be profane, or that reflects negatively on or disparages Sponsor or any company/entity or does not comply with the Official Rules. Submissions must be suitable for presentation in a public forum, in sole determination of judges and/or Sponsor. All material submitted becomes the sole property of Sponsor and will not be returned. Sponsor reserves the right to reproduce the submissions in full or edit and enhance the submissions at its discretion. Sponsor is authorized to use submissions as it sees fit, including usage in advertising, internet, trade and editorial (print, online and broadcast media). Return of any prize and/or notification as undeliverable will result in disqualification and an alternate winner will be selected. Limit one prize per household. No substitution or transfer of prize by winner permitted. Sponsor reserves the right to substitute prize of equal or greater value. All federal, state and local taxes are the sole responsibility of winner. By accepting prize, winners agree to hold Sponsor, its respective directors, officers, employees and assigns, harmless against any and all claims and liability arising out of use of prize. Winners assume all liability for any injury or damage caused, or claimed to be caused, by participation in this promotion or use or redemption of any prize. Acceptance of prize constitutes permission to the Sponsor and its agencies to interview winners and use their name, likeness, voice, and interview for purposes of advertising, internet, trade and editorial (print, online and broadcast media) without further compensation, unless prohibited by law. Winners may be required by Sponsor to submit pictures of nursery before and after nursery makeover. By participating in this promotion, entrants agree to be bound by the Official Rules and the decisions of the judges which are final. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any promotional materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control. Sponsor is not responsible for any typographical or other error in the printing, the offering or the announcement of the prizes or in the administration of the promotion. In the event of a printing or other error, neither Sponsor, nor its respective agents and agencies shall have any liability. In no event will Sponsor be obligated to award more than the stated number of prizes.

    INTERNET CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Not responsible for late, lost, damaged, incomplete, illegible, misdirected mail, or for faulty, incorrect or mistranscribed phone/email transmissions, incorrect announcements of any kind, technical hardware or software failures of any kind including any injury or damage to any person's computer related to or resulting from participating in or experiencing any materials in connection with the promotion, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmission that may limit a user's ability to participate in the promotion. Sponsor reserves the right to cancel or modify the contest if fraud, misconduct or technical failures destroy the integrity of the program; or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper administration of the program as determined by Sponsor/judging agency, in their sole discretion. Any damage made to the Web site will be the responsibility of the authorized email account holder of the email address submitted at the time of entry. "Authorized email account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Participant may be requested to provide Sponsor with proof that the participant is the authorized email account holder of the email address associated with the account/submission. Proof of submission will not be deemed to be proof of receipt by Sponsor. Any use of robotic, automatic, programmed or the like methods of participation will void all such submissions by such methods. Sponsor reserves the right to prohibit the participation of an individual if fraud or tampering is suspected or if the individual fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules.

  7. WINNERS: The winners from each entry period will be made available at www.similacsimplepac.com approximately 5 weeks after the close of each entry period, or send a separate, stamped, self addressed #10 envelope to: Similac® Custom Nursery Design Contest with Ty Pennington Winners, P.O. Box 5567, Blair, NE 68009-5567, to be received by February 27, 2009.
